Terms of Service

The Terms of Service ("Terms") was last updated on July 19, 2022.

TongLe Chinese ("TongLeC", "we", "us", "our") strives to improve lives through education. Currently, we provide a platform allowing guardians and students to connect to Chinese language instructors. To assist the creation of a positive experience for all parties involved, the following Terms of Service ("Terms") exist as a legal and binding contract between you ("you", "your", "user") and TongLeC regarding your activities on the TongLeC website, as well as on any other applications and Services governed by TongLeC ("Services").

Please read the following Terms carefully. By accessing, browsing, or registering for our website, you acknowledge that you have read, understood, and agree to be bound by the following Terms, as well as our Privacy Policy and any additional guidelines as defined below.

01. Accounts
You need an account for most activities on our platform, including to purchase courses. When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address and phone number. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password.
You may not transfer your account to someone else or use someone else’s account. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting our Support Team. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.
Only parents and legal guardians of at least 18 years of age may create an account on TongLeC and use our Services. Users under the age of 18 may have an account created on their behalf by a parent or legal guardian. If we discover that you have created an account that violates these rules, we may terminate your account without warning. Note that use of our website is not available to any users who have been previously removed from our website, or who’s usage is not in compliance with all applicable laws.
You can terminate your account at any time by contacting registrar@tonglec.org. Please clearly indicate your intent to delete your account in your communication with us. Check our Privacy Policy to see what happens when you terminate your account.
11. Purchases
11.01 Pricing
The prices of goods and Services on TongLeC are determined at our discretion, following the consideration of the prices of comparable goods on the market. We reserve the right to alter prices at any time. However, any changes in prices will be attributed purely to consideration of our business and will not be intentional measures of price discrimination.
Most price changes may be attributed foreseeably to promotions. We occasionally run promotions and sales for our Services, during which certain Services are available at discounted prices for a set time. The price applicable to the Services will be the price at the time you complete your purchase of the Services (at checkout). Note that any price offered for Services may be different when you are logged into your account from the price available to users who aren’t logged in, because some of our promotions are available only to new users.
If you are in a country where use and sales tax, goods and Services tax, or value added tax is applicable to consumer sales, we are responsible for collecting and remitting that tax to the proper tax authorities. Depending on your location, the price you see may include such taxes, or tax may be added at checkout.
11.11 Payments
You agree to pay the fees for Services that you purchase, and you authorize us to charge you through appropriate means of payment for those fees. TongLeC works with payment service providers to offer you convenient payment methods and to keep your payment information secure. Check out our Privacy Policy for more details.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to our Services, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.
11.21 Refunds
If a Service you purchased is not what you were expecting, you can request, up until 7 days following commencement of the Service, that TongLeC provide a refund. We reserve the right to apply your refund as a refund credit, as a refund to your original payment method, or via other noticeable and legal means, at our discretion, depending on capabilities of our payment service providers and other factors. No refund is due to you if you request it after 7 days following commencement of the Service in question. However, if the Service you previously purchased is inaccessible for legal or policy reasons, you are entitled to a refund beyond this limit. TongLeC also reserves the right to refund students beyond this limit in cases of suspected or confirmed account fraud.
To request a refund, please contact our Support Team at registrar@tonglec.org. Please clearly provide all necessary identification when initiating communication with us for the purpose of a refund: (a) The parent or guardian's TongLeC account username and phone number (b) The payment method and needed information for a refund (c) The child's name and their enrolled class and (d) A screenshot of this order in order history, with the order ID visible. We will contact you if further communication is necessary.
At our discretion, if we believe you are abusing our refund policy, we reserve the right to deny your refund, restrict you from other future refunds, ban your account, and/or restrict all future use of our Services. If we ban your account or disable your access to our Services due to your violation of these Terms, you will not be eligible to receive a refund.
21. Disputes
21.01 Dispute Resolution
This Disputes section applies only if you live in the United States or Canada. Most disputes allow for an amicable resolution, so please first contact our Support Team before bringing a formal legal case.
21.11 Arbitrations
If we can’t resolve our dispute amicably, you and TongLeC agree to resolve any claims related to these Terms (or our other legal terms) through final and binding arbitration, regardless of the type of claim or legal theory. If one of us brings a claim in court that should be arbitrated and the other party refuses to arbitrate it, the other party can ask a court to force us both to go to arbitration (compel arbitration). Either of us can also ask a court to halt a court proceeding while an arbitration proceeding is ongoing.
Any disputes that involve a claim of less than $10,000 USD must be resolved exclusively through binding non-appearance-based arbitration. A party electing arbitration must initiate proceedings by filing an arbitration demand with the American Arbitration Association (AAA). The arbitration proceedings shall be governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer-Related Disputes. You and we agree that the following rules will apply to the proceedings: (a) the arbitration will be conducted by telephone, online, or based solely on written submissions (at the choice of the party seeking relief); (b) the arbitration must not involve any personal appearance by the parties or witnesses (unless we and you agree otherwise); and (c) any judgment on the arbitrator’s rendered award may be entered in any court with competent jurisdiction. Disputes that involve a claim of more than $10,000 USD must be resolved per the AAA’s rules about whether the arbitration hearing must be in-person.
21.21 No Class Action
We both agree that we can each only bring claims against the other on an individual basis. This means: (a) neither of us can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action; (b) an arbitrator can’t combine multiple people’s claims into a single case (or preside over any consolidated, class, or representative action); and (c) an arbitrator’s decision or award in one person’s case can only impact that user, not other users, and can’t be used to decide other users’ disputes. If a court decides that this "No class actions" clause isn’t enforceable or valid, then this "Dispute Resolution" section will be null and void, but the rest of the Terms will still apply.
31. TongLeC's Rights
31.01 Copyright
All right, title, and interest in and to the TongLeC platform and Services, including our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide through our Services are and will remain the exclusive property of TongLeC and its licensors. Our platforms and services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing gives you a right to use the TongLeC name or any of the TongLeC trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding TongLeC or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
All content and Services provided by TongLeC is copyrighted by TongLeC, except where otherwise noted. We reserve all rights to content copyrighted by us. Where noted, copyright is held by an external party, and we are licensed or otherwise legally permitted to use that content from said party.
31.11 Limited Liability
Under no circumstances, including, but not limited to, negligence, will TongLeC be liable for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation damages arising from any unsuccessful court action or legal dispute, lost business, lost revenues or profits, loss of data, or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) even if TongLeC has been advised of the possibility of such damages arising out of or relating (a) to the terms (b) your use of TongLeC Services or (c) any other interactions with TongLeC or any third-party through or in connection with TongLeC Services, including other users. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, TongLeC’s liability will be limited to the fullest extent permitted by applicable law.
31.21 Indemnification
You agree to indemnify, defend, and hold harmless TongLeC and our partners against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit (b) your use of the Services (c) your violation of these Terms or (d) your violation of any rights of a third party.
41. Terms Updates
Upon opening an account, you accept the Terms in the present form posted on our website. We reserve the right to modify, add, or remove portions of the Terms at any time, at our discretion. Please check the Terms and any Guidelines periodically for changes that are made after you open your account. Your continued use of the Services after the posting of changes constitutes your binding acceptance of such changes.
All modifications to the Terms will be effective immediately, unless stated otherwise. Any revised Terms shall supersede all previous Terms. If you do not agree to the revised Terms, you must discontinue your use of the Services. Disputes arising under these Terms will be resolved in accordance with the version of the Terms in place at the time the dispute arose.

01. Data From You
01.01 What Data We Collect
The data collected by TongLeC can be broadly classified into 3 categories: account data, payment data, and analytics data.
Account data consists of the data you enter when creating and operating your account on our Services. Payment data consists of data regarding monetary transactions made on our Services. Analytics data consists of system and usage data collected through automatic means.
01.11 Why We Collect Data
TongLeC collects much of your data for strictly necessary purposes, to ensure that the whole process of course enrollment is as optimized and efficient as possible.
We also collect additional information for the purposes of personalizing your experience, facilitating communication with you about our Services, and improving our Services.
01.21 How We Collect Data
First and foremost, TongLeC collects data which you directly enter onto our website. For example, this includes your email and phone number provided upon signup, as well as information about you and your child which is necessary for course registration.
TongLeC and service providers acting on our behalf use server log files and automated data collection tools such as cookies, scripts, and tags (together, "Data Collection Tools") when you access and use the Services. These Data Collection Tools automatically track and collect certain system and usage data when you use the Services.
01.31 Who We Share Data With
We do not sell your data to third parties. However, we will share your information with third parties or the government if required by law.
Only so much of your data is shared with course consultants and instructors as is necessary for them to effectively register your child for a class and deliver classroom instruction, respectively.
We do not use any third-party analytics system, except that of Google Analytics.
11. Security
TongLeC takes security very seriously, and we enact modern security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal data that we collect and store. However, no security system is perfect, so we cannot guarantee that communications between you and TongLeCs, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately. Please contact our Support Team if necessary.
21. Your Rights
21.01 Accessing Your Data
You may access and update your data through our website. If you have additional requests, please contact our Support Team.
21.11 Deleting Your Data
